Terms of Service

1. Agreement to Terms

By accessing or using Operator at runoperator.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Operator, based in Amsterdam, Netherlands.

2. Description of Service

Operator is an AI-powered business operations platform for direct-to-consumer (DTC) and ecommerce brands. The Service provides analytics dashboards, AI-generated operational reports, ad copy generation, creative tools, and integrations with third-party platforms including Shopify, Meta Ads, and Klaviyo.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you become aware of any unauthorized use of your account. You must be at least 18 years old to use the Service.

4. Subscription and Payments

• The Service is offered on a monthly subscription basis.
• A 14-day free trial is available for new accounts. No credit card is required to start the trial.
• Payments are processed securely through Stripe. All fees are in US Dollars (USD).
• Subscriptions renew automatically each month. You will be charged at the beginning of each billing cycle.
• You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
• We reserve the right to change pricing with 30 days advance notice. Existing subscribers will be notified before any price change takes effect.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Share your account credentials with third parties or allow others to access your account.
• Use the Service to store or transmit malicious code, malware, or harmful content.
• Resell, sublicense, or redistribute the Service without written permission.

6. Third-Party Integrations

The Service connects to third-party platforms (Shopify, Meta, Klaviyo, and others) on your behalf using API credentials you provide. You are responsible for ensuring you have the right to share this access with our platform. We access your third-party data in accordance with our Privacy Policy. We are not responsible for the availability, accuracy, or functionality of third-party services. Changes to third-party APIs may temporarily affect the Service.

7. AI-Generated Content

The Service uses artificial intelligence to generate reports, ad copy, and other content. AI-generated content is provided as suggestions and should be reviewed before use. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. You are solely responsible for any content you publish or use that was generated by the Service. AI-generated insights are not financial, legal, or professional advice.

8. Intellectual Property

The Service, including its design, code, features, and branding, is the intellectual property of Operator and is protected by applicable copyright and trademark laws. You retain ownership of all data you provide to the Service. You retain ownership of content you create using the Service (ad copy, reports, etc.). You grant us a limited license to process your data solely for the purpose of providing the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Amsterdam, Netherlands.

13. Changes to These Terms

We may update these terms from time to time. When we make material changes, we will notify you via email or through a notice on our platform at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
